Terms of Service (EULA)

These Terms of Service ("Terms") constitute a legal agreement between you ("You" or "User") and Aithora ("We," "Us," or "Developer") governing your access to and use of the Aithora mobile application and services (the "Licensed Application").

By downloading, installing, or using the Licensed Application, You agree to be bound by these Terms. If You do not agree to these Terms, do not use the Licensed Application.

Acknowledgment: You and Aithora acknowledge that these Terms are concluded between You and Aithora only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Aithora, not Apple or Google, is solely responsible for the Licensed Application and the content thereof.

1. Scope of License

The license granted to You for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that You own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, or on any Android device as permitted by Google Play's terms.

2. Description of Service & AI Disclaimer

Aithora provides access to Artificial Intelligence ("AI") agents and workflows using Large Language Models (LLMs).

Important AI Disclaimer: AI agents are experimental technologies. They may generate inaccurate, biased, or inappropriate content ("hallucinations"). Aithora does not guarantee the accuracy of any output. The Service is not a substitute for professional legal, medical, or financial advice.

3. Subscriptions and Payments

3.1 Automatic Renewal

Aithora may offer auto-renewable subscription plans ("VIP Services") to access premium features.

3.2 Credits

Credits purchased are digital consumables, non-refundable, and have no cash value.

4. User Conduct & Content Policy

You agree to use the Licensed Application only for lawful purposes. You represent that You are entirely responsible for all content that You upload or generate.

We have a zero-tolerance policy for objectionable content and abusive users. We reserve the right to review User content to ensure compliance. If You violate these Terms, We may:

Users can report objectionable content or abusive behavior by contacting support, and We will act on such reports within 24 hours.

5. Maintenance and Support

Aithora is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms, or as required under applicable law. You and Aithora acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

6. Warranty

Aithora is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price for the Licensed Application to You; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Aithora's sole responsibility.

7. Product Claims

You and Aithora acknowledge that Aithora, not Apple, is responsible for addressing any claims of You or any third party relating to the Licensed Application or Your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Rights

You and Aithora acknowledge that, in the event of any third party claim that the Licensed Application or Your possession and use of that Licensed Application infringes that third party’s intellectual property rights, Aithora, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

9. Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using Your Application (e.g., if You have a VoIP application, then You must not be in violation of your wireless data service agreement when using Your Application).

11. Third Party Beneficiary

You and Aithora acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms, and that, upon Your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against You as a third party beneficiary thereof.

12. Termination and Account Deletion

12.1 Termination by Aithora

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or involves fraudulent payment activity.

12.2 Account Deletion by User

You have the right to delete your account at any time. You can initiate this process directly within the Application via Settings > Account Deletion.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AITHORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
